Both Racing TV and Sky Sports Racing have warned that the proposed watershed would leave them commercially unviable in the Irish minimum deposit casino market. “It is completely untrue that there is any kind of technical impediment from them showing different advertisements in two different states,” Browne stated in the Seanad this week. “It does not stand up to any kind of scrutiny. In fact, TV stations now have the software to show two people in two houses beside each other different ads at the same time.”

The Minister went on to reject the idea that Racing TV and Sky Sports could be granted a “monopoly” on gambling advertising by circumventing the 5.30am to 9pm watershed for their channels.

“If we were to give two TV stations a monopoly on gambling advertising into the country, it would not survive under competition law,” he argued. “This would give them an extraordinary monopoly providing enormous financial worth to those companies. It is not something that would work in this State.”

Media requests an exemption from the advertising ban

At the crux of the stand-off are the broadcasters’ assertions that losing the ability to show gambling adverts would undermine their financial viability for serving Irish audiences. “We can categorically say that no deals have been reached with bookmaker partners on this,” Stevenson stated. His comment appeared to contradict reports that Racing TV was exploring a ‘Plan B’ option involving increased appearances by betting firms.

Those reports suggested both Racing TV and Sky Sports Racing were preparing concepts where more bookies could effectively pay for advertising through regular free promotional spots during broadcasts. However, Racing TV insists such an approach would violate Ofcom rules in the UK.

As per the Irish government, the plan is to prohibit most gambling ads from TV and radio between the hours when children are most likely to be viewing or listening. However, the racing industry argues this approach fails to account for its special status and tight regulatory oversight. “They believe these represent key pillars in the ability to market the sport and, importantly, our bloodstock sector,” Dooley said of the industry’s stance. “They are seriously worried that if racing were to disappear from our television screens because it would be no longer commercially viable for those channels to broadcast here at home, it would have a detrimental impact on the Irish horseracing industry.”

For his part, Minister Browne insisted the Gambling Regulation Bill has gone out of its way to protect Irish racing interests and maintain the sport’s visibility to the public:

“We have gone to extraordinary lengths in the legislation to ensure that the horse racing and greyhound racing sector is protected. For example, we could have put blanket bans on sponsorship. We have put provisions into the legislation to ensure that what we call incidental advertising does not impact on the showing of horse racing.”

He said branding and marketing visible at racecourses like sponsored races, bookies setting odds and trackside signage will all still be permissible within the legislation. “Therefore, anything that can be seen at a horse race today can still be seen after the legislation passes,” Browne stated.

The Minister suggested the racing bodies are effectively demanding special favoured nation status. “Some in the horse racing sector has asked that racing channels would, in effect, be given a monopoly on showing gambling advertisements in the Republic,” he said.

Regulator unmoved

Despite rising pressure from various senators and racing stakeholders, the government appears unlikely to amend the Gambling Regulation Bill to exempt channels like Racing TV and Sky Sports Racing from the upcoming ad restrictions.

The legislation completed its passage through the Dáil Eireann (lower house) and has now entered the first stages in the Seanad. Several more debates and committee sessions lie ahead before it can be signed into law.

As it currently stands, the Bill rejects exemptions and maintains the watershed prohibiting most gambling ads from 5.30am to 9pm across TV, radio and digital platforms.
