Spanish consumers are ordered to declare gambling winnings in tax returns

Spanish gamblers who have been playing fast and loose with their tax obligations are in for a rude awakening as the government is turning its gaze towards tax on winnings from both land-based and online casinos. 

Although up till now the small matter of paying the government its share of any winnings was not particularly enforced, it looks as though things are set to change drastically following a surprise announcement by the tax administration agency in Spain. Agencia Tributaria (AEAT) director general Soledad Fernández stated that the agency would increase its scrutiny of profits from online casinos. Also in the line of fire are profits from cryptocurrency, foreign income and property rentals. 

And, as the Spanish population is on the cusp of filing income tax returns for the year 2023, the decision couldn’t have come at a more inconvenient time. So far, the agency has already issued around 2.9 million notices to taxpayers, including 64,000 notices about winnings arising from gambling and around 1 million notices regarding profits from crypto. The move is unprecedented. 

The Spanish government had already been heavily criticized for lowering the threshold for tax due on gambling profits in 2022. Now, things look set to heat up as critics like the Partido Popular (PP), Spain’s Conservative Party and opposition, are unlikely to let this go by quietly. 

Unpacking the tax requirements for gambling winnings in Spain

There was a time when winnings from the best online casinos weren’t subject to any tax if you’re in Spain – as long as these are under €300. Then, in September 2022 the Ministry of Finance decided to close what it referred to as a “loophole” and to start charging tax on all winnings, including those under the €300 threshold. This was done by amending tax model 190 on personal income declarations for business, economic, gambling, and capital gains, which also required the declaration of prizes of under €300. 

To understand exactly how much tax a Spanish gambler who hits it lucky at online casinos will now have to pay, we need to backtrack a little and cover the different classifications of gambling under Spanish law. 

In Spain, the law recognises two types of gambling activities for the purposes of filing a tax return – the first refers to winnings from state-controlled lotteries, both of which have a long and illustrious history in the country. In this case, the state applies a flat rate of 20% tax on winnings over €2,500 that is applied to a personal income exemption of €40,000 per year. 

The other category is for winnings derived from private gambling outlets. Winnings from an online casino would fall within the latter category, and it’s here that things get a bit more complicated. The actual percentage of tax paid depends on two factors – how much you win and your base income for that year. To put it simply the amount you win is added to your gross annual  income, and the following tax rates are applied to the entire amount: 

  • Income (including any winnings) up to €12,450 euros: 19%.
  • Between €12,450 and €20,200: 24%.
  • Between €20,200 and €35,200: 30%.
  • Between €35,200 euros and €60,000: 37%.
  • Between €60,000 and €300,000: 45%.
  • More than €300,000: 47%.

Up till 2023, any winnings under $300 did not qualify for the above and Spanish gamblers were under no obligation to declare them. As of last year, the requirement of disclosure was imposed on any amount of winnings, no matter how small, with the obligation already in force when the 2022 base year tax return was being filed. However, it’s only this year that the government has stepped up efforts to ensure this law is respected, sending out notices ahead of tax filing season and warning taxpayers that any infringements would be prosecuted. 

Based on the newly-enforced law, let’s say that you win €100 while playing at online casinos, and your base income is $30,000, which means that your total income is €30,100. Here’s how you will be taxed: 

  • 12,450 at 19%.
  • 7,750 at 24%.
  • 9,900 at 30% 

Sports betting and casino winnings need to be declared on a separate form from the regular income. Although this law has been in force throughout 2023, it appears that efforts now are going to be revved up to ensure that Spanish gamblers pay the government its dues.  

So what happens if you fail to declare any winnings? For starters, you’ll be falling foul of the Spanish Tax Agency, which has already declared that it will be going through casino revenue with a fine-tooth comb so as to scope out anyone trying to shirk their responsibilities. If you’re caught, you will obviously have to pay the tax anyway, but you’re also looking at a late payment fee and a fine that can be anything between 50% and 150% of the tax owed. 

Sadly, the chances of being caught out are reasonably high, as the General Directorate of Gaming Regulation in Spain automatically receives all data collected about the identity and activity of players (including winnings). This applies not only to land-based but also to online casinos. This means that they literally have a list of all the names of those who should be paying gambling tax. Very difficult to escape that one, so our advice is in all matters to respect the law! 

Specific declarations on crypto and foreign transactions

Spain has always viewed crypto and foreign transactions (such as those involving NFTs) as capital gains and taxed them accordingly. Taxpayers were always obliged to declare any profits in their annual tax return, with tax being levied on the profit made when you sell your crypto for fiat or for other cryptocurrencies, or even when you sell an NFT. The amount you pay depends on the amount of net profit made, as per the below table: 

  • Profits up to €6,000 – 19%  
  • Profits between €6,000 and €50,000 – 21%  
  • Profits between €50,000 and €200,000 – 23%  
  • Profits between €200,000 – €300,000 – 27%  
  • Profits over €300,000 – 28%  

The amount of profit is calculated using a specific formula that depends on the price fluctuation since you originally purchased your crypto. Let’s take a concrete example: 

  • You buy 0.05 BTC for €3.000 + 2% transaction fees. In this case, your cost €3,060.
  • You then sell it for €3,400. This means you’ve made a profit of €340 which is considered as a capital gain and is thus taxed at 19%.

Buying crypto with fiat is not taxable while receiving crypto via a mining process is taxed as regular income. The same applies to any crypto received as a salary.  

So what has changed? While tax rates have remained the same, the finance ministry has sent out strong signals that violations will be taken more seriously. According to Spanish press El Economista, a new tax reform has been enacted allowing the ministry to seize any crypto or NFTs in case of failure to pay taxes. This year the Agencia Tributaria has already sent out 325,000 warnings to those who failed to declare their earnings in time for the March deadline. And, thanks to a collaboration with crypto exchanges, crypto transactions are very effectively monitored. As with the case of those who fail to pay income tax on winnings from online casinos, discovery is very likely.

Regulatory Scrutiny and Legal Disputes

The DIA of New Zealand has announced plans to file civil penalty proceedings against SkyCity Entertainment Group in the High Court. This legal move increases the company’s problems, potentially indicating regulatory attention and financial consequences.  

SkyCity Casino Management Limited is accused of failing to comply with the Anti-Money Laundering and Countering Financing of Terrorism Act 2009. In the event that such claims were proven partially or completely true, SCML could be fined an amount of up to $/€8.0 million. 

Draft filings outline five causes of action deemed “important” compliance concerns under the Act. SkyCity stated that these issues are primarily historical, with some having previously been self-reported to the department.

However, things could get worse before they improve. SkyCity has written down the value of its Adelaide casino by $/€45.6 million. However, an independent examination by the South Australian government into whether it should be stripped of its licence is still pending. It will not begin until a settlement with AUSTRAC is struck.

Latvia Concourt finds that gambling restrictions have breached the Constitution

It’s finally official – the Latvian government cannot stop casinos from operating in the country’s capital of Riga. The Constitutional Court recently released its ruling on the matter, deeming the forced closure of some 42 gambling halls from within the historic centre of the capital to be an illegal and unjustified violation of rights.

This ruling effects the organization of gambling, including the operation of online casinos, as a legal form of business in conditions of free competition, the Constitutional Court noted that commercial activity is one of the prime intended uses of the city of Riga. On this basis, the court ruled that Riga Municipality had failed to bring forth valid reasons why the commercial activity of gambling should not be allowed and thus reversed the government decision.

Both land-based and online casinos in Latvia are licensed to operate by the Latvian Gambling and Lottery Supervision Inspection, which makes such activities 100% legal.

Latvian Gambling Business Association says rights were violated

Trouble started brewing when the Latvian government decided to enforce a legal provision stipulating that providing gambling services is not allowed in the entire administrative territory of Riga unless the gambling venues are located within four or five-star hotels. The provision resulted in a number of gambling hall operators having their premises closed down. All the operators were working with a valid license.

The legal regulation in question was enacted by the Riga City Council some six years ago. In 2021, the municipality devised a new spatial plan that necessitates the closure of gambling halls in order to be implemented. Then, in September 2023, the council took the definitive step of revoking the gambling licenses of 139 gambling halls, giving them a five-year time limit to close down operations.

This prompted the Latvian Interactive Gambling Business Association (LIAB), which is tasked with presenting a united industry opinion and promoting responsible gambling, to cry foul, stating that the measure violated the rights of several people, including the licensed operators and the foreign investors who had placed their trust in the businesses.

As a result, several entities filed legal complaints about the issue, until the matter ended up in front of the Constitutional Court. The list of complainants included Olympic Casino Latvia, Alfor, and Joker, who claimed that the municipality’s new spatial plan violated Article 105 of the Constitution, which safeguards property uses and license restrictions through lawful channels.

The spatial plan was temporarily suspended by the Minister of Environment Protection and Regional Development Artūrs Toms Plešs, delaying the closure of gambling halls. However, the next minister, Māris Sprindžuks, reversed his predecessor’s decision. The Riga City Council finally brought matters to a head by revoking 139 licenses and closing off 49 gambling establishments, claiming that this would protect the public from the negative effects of gambling.

As a result, the matter ended up being debated in front of the highest court of the country, where the Riga Municipality defended its position by insisting that the government had every right to restrict gambling activities in certain areas. However, while the court agreed with this in principle, it added that the organization of a gambling business is a lawful commercial activity in keeping with the conditions of free competition.

Communicating its decision to LETA, which is the main Latvian news agency, the court explained that when limiting this right the municipality must offer a just reason for this decision, otherwise it is a direct violation of human rights. The court explained that, in order to be legal, such gambling restrictions are not only the protection of the rights of residents to be shielded from the risks of problem gambling that need to be considered. The municipality also needs to respect the right to business that’s protected by Article 105 of the Latvian constitution. Banning gambling in sensitive areas like where there are educational, cultural, sports or children’s facilities is reasonable, but the municipalities must first carry out an assessment exercise to determine all such relevant aspects.

The Riga City Council had failed to carry out this step before it decided to impose gambling restrictions on the entire territory of Riga. In view of this, the court decided that the provisions violated the Constitution and thus revoked them in their entirety.

Background of Gambling in Latvia

Land-based casinos were legalized in Latvia way back in 1998 and, since then, it has been working on improving its legal infrastructure. In 2005, the law was updated to include online casinos, providing a solid framework for all offshore gaming activities. All gambling activities are regulated by the Lotteries and Gambling Supervisory Inspection, which covers casino gaming, poker, bingo, and betting. Fantasy gaming is yet to be legalized.

Latvia is one of the few jurisdictions that has zero tolerance for unlicensed online casinos, and it has so far succeeded in enforcing this rule. Proposed Revisions to the Bulgarian Gambling Act Rejected by Parliament

The Bulgarian Parliament rejected proposed amendments to the Gambling Act aimed at reducing the broad influence of gambling-related ads at new online casinos. The amendments, offered by Kostadin Kostadinov of the Vazrazhdane party, were defeated 67-29, despite backing from BSP for Bulgaria and the populist group “There Is Such a People”.  

The proposed measures aim to address social problems associated with gambling, including the implementation of stronger advertising regulations at top-rated online casinos and the establishment of an empowered register for those suffering from gambling addiction. 

However, dissident voices from GERB-UDF warned about the potential negative impact on municipal sports institutions, noting that such measures would only scratch the surface of addiction’s underlying roots. 

The Proposal Also Included a Fine for Media Outlets

Earlier this week, some of Bulgaria’s best brains joined in the endless debates about gambling in Sofia’s Parliamentary House. The controversy began at the end of last year when Kostadin Kostadinov and his nationalist party, Revival (Bulgarian: ‘Vazrazhdane’), drafted a proposal to change specific provisions of the country’s current Gambling Law.  

Kostadinov’s goal was to develop a more consistent regulatory structure. One noteworthy point of interest was the near-complete revision of advertising restrictions at best online casinos.  

The reforms were sought because the political party Vazrazhdane feels that they are required to combat the onslaught of ads for gambling that dominate TV, radio, and other electronic media, reaching children and vulnerable people – a clear violation of present legislation. 

Four months after Vazrazhdane stated the draft, Kostadinov spoke from the Parliamentary tribune on March 29th, criticising his colleagues for their lack of interest in the document and the failure of the competent committees to review it.  

According to the Bulgarian News Agency, he said that Vazrazhdane would once again campaign for the amendments’ adoption, bringing the proposed modifications up for consideration during the first plenary session in April.  

Will Banning Advertising On Gambling Solve Any Problems

Lyuben Dilov, a member of the GERB-UDF party, expressed concerns about the proposed Gambling Act changes. According to Gambling News, Dilov went on to say that if the proposed modifications, which include a blanket ban on gambling advertising, are passed, these institutions will lose a significant source of revenue. 

He was especially concerned about these reforms’ potentially harmful impact on municipal sporting institutions, which frequently rely on sponsorships and relationships with gambling enterprises for money and sponsorship.  

Dilov disagreed with the idea of entirely prohibiting gambling advertisements. He stated that such a policy would simply address the symptoms of gambling addiction rather than the underlying reasons. In his opinion, the core causes of gambling addiction are linked to human nature and personal circumstances, which he feels should stay “untouched and unchanged”.
