More SkyCity Bigwigs Resign

In a surprise development, SkyCity Entertainment Group faces another significant setback as David Christian, the Chief Operating Officer, decides to leave the company. This follows the earlier exits of the company’s CEO, Michael Ahearne, and CFO, Julie Amey, marking another departure from the casino operator’s senior ranks. 

Christian, who had been with SkyCity since 2005 and became COO in February 2021, left his position on April 12, 2024. His departure has impacted investor confidence, leading to a 1.33% drop in SkyCity’s shares to $/€1.85, resulting in an 18.14% decline over the past year. 

In response to his departure, SkyCity has acted swiftly to secure stability, with CEO Callum Mallet stepping in to cover Christian’s duties until a permanent successor is appointed. Callum Mallet praised David’s extensive tenure with the company, highlighting his contributions in many senior positions. Specifically, David’s leadership at SkyCity Adelaide during a particularly challenging period showcased his resilience and strong management skills. 

According to iGB (iGamingBusiness.com), SkyCity board chair Julian Cook stated, “On behalf of the SkyCity Adelaide board and the SkyCity board, I thank David for his tireless efforts and dedication to SkyCity and wish him well.”

SkyCity’s subsidiary is facing a civil penalty prosecution by the New Zealand Department of Internal Affairs after the company was suspected of violating anti-money laundering and terrorist funding legislation in both Australia and New Zealand. Regulatory Scrutiny and Legal Disputes

The DIA of New Zealand has announced plans to file civil penalty proceedings against SkyCity Entertainment Group in the High Court. This legal move increases the company’s problems, potentially indicating regulatory attention and financial consequences.  

SkyCity Casino Management Limited is accused of failing to comply with the Anti-Money Laundering and Countering Financing of Terrorism Act 2009. In the event that such claims were proven partially or completely true, SCML could be fined an amount of up to $/€8.0 million. 

Draft filings outline five causes of action deemed “important” compliance concerns under the Act. SkyCity stated that these issues are primarily historical, with some having previously been self-reported to the department.  

SkyCity’s net debt was $/€443 million in June, with an additional $/€390 million in undrawn debt reported. In last year’s annual reports, the company stated that it expected that sum to rise due to some big one-time payments but that it would remain comfortably within its debt limits. 

However, things could get worse before they improve. SkyCity has written down the value of its Adelaide casino by $/€45.6 million. However, an independent examination by the South Australian government into whether it should be stripped of its licence is still pending. It will not begin until a settlement with AUSTRAC is struck.  

Asset sales must be discussed among the executives attending, at the very least. On the other hand, it might not be easy to find a buyer willing to pay anything near the middle market for an asset with as many barnacles as Adelaide. 

In New Zealand, online casino regulators are still considering suspending SkyCity’s licence for 10 days due to alleged violations of regulations governing reducing gambling harm to customers and incidences of ongoing play.

Latvia Concourt finds that gambling restrictions have breached the Constitution

It’s finally official – the Latvian government cannot stop casinos from operating in the country’s capital of Riga. The Constitutional Court recently released its ruling on the matter, deeming the forced closure of some 42 gambling halls from within the historic centre of the capital to be an illegal and unjustified violation of rights.

This ruling effects the organization of gambling, including the operation of online casinos, as a legal form of business in conditions of free competition, the Constitutional Court noted that commercial activity is one of the prime intended uses of the city of Riga. On this basis, the court ruled that Riga Municipality had failed to bring forth valid reasons why the commercial activity of gambling should not be allowed and thus reversed the government decision.

Both land-based and online casinos in Latvia are licensed to operate by the Latvian Gambling and Lottery Supervision Inspection, which makes such activities 100% legal.

Latvian Gambling Business Association says rights were violated

Trouble started brewing when the Latvian government decided to enforce a legal provision stipulating that providing gambling services is not allowed in the entire administrative territory of Riga unless the gambling venues are located within four or five-star hotels. The provision resulted in a number of gambling hall operators having their premises closed down. All the operators were working with a valid license.

The legal regulation in question was enacted by the Riga City Council some six years ago. In 2021, the municipality devised a new spatial plan that necessitates the closure of gambling halls in order to be implemented. Then, in September 2023, the council took the definitive step of revoking the gambling licenses of 139 gambling halls, giving them a five-year time limit to close down operations.

This prompted the Latvian Interactive Gambling Business Association (LIAB), which is tasked with presenting a united industry opinion and promoting responsible gambling, to cry foul, stating that the measure violated the rights of several people, including the licensed operators and the foreign investors who had placed their trust in the businesses.

As a result, several entities filed legal complaints about the issue, until the matter ended up in front of the Constitutional Court. The list of complainants included Olympic Casino Latvia, Alfor, and Joker, who claimed that the municipality’s new spatial plan violated Article 105 of the Constitution, which safeguards property uses and license restrictions through lawful channels.

The spatial plan was temporarily suspended by the Minister of Environment Protection and Regional Development Artūrs Toms Plešs, delaying the closure of gambling halls. However, the next minister, Māris Sprindžuks, reversed his predecessor’s decision. The Riga City Council finally brought matters to a head by revoking 139 licenses and closing off 49 gambling establishments, claiming that this would protect the public from the negative effects of gambling.

As a result, the matter ended up being debated in front of the highest court of the country, where the Riga Municipality defended its position by insisting that the government had every right to restrict gambling activities in certain areas. However, while the court agreed with this in principle, it added that the organization of a gambling business is a lawful commercial activity in keeping with the conditions of free competition.

Communicating its decision to LETA, which is the main Latvian news agency, the court explained that when limiting this right the municipality must offer a just reason for this decision, otherwise it is a direct violation of human rights. The court explained that, in order to be legal, such gambling restrictions are not only the protection of the rights of residents to be shielded from the risks of problem gambling that need to be considered. The municipality also needs to respect the right to business that’s protected by Article 105 of the Latvian constitution. Banning gambling in sensitive areas like where there are educational, cultural, sports or children’s facilities is reasonable, but the municipalities must first carry out an assessment exercise to determine all such relevant aspects.

The Riga City Council had failed to carry out this step before it decided to impose gambling restrictions on the entire territory of Riga. In view of this, the court decided that the provisions violated the Constitution and thus revoked them in their entirety.

Background of Gambling in Latvia

Land-based casinos were legalized in Latvia way back in 1998 and, since then, it has been working on improving its legal infrastructure. In 2005, the law was updated to include online casinos, providing a solid framework for all offshore gaming activities. All gambling activities are regulated by the Lotteries and Gambling Supervisory Inspection, which covers casino gaming, poker, bingo, and betting. Fantasy gaming is yet to be legalized.

Proposed Revisions to the Bulgarian Gambling Act Rejected by Parliament

The Bulgarian Parliament rejected proposed amendments to the Gambling Act aimed at reducing the broad influence of gambling-related ads at new online casinos. The amendments, offered by Kostadin Kostadinov of the Vazrazhdane party, were defeated 67-29, despite backing from BSP for Bulgaria and the populist group “There Is Such a People”.  

The proposed measures aim to address social problems associated with gambling, including the implementation of stronger advertising regulations at top-rated online casinos and the establishment of an empowered register for those suffering from gambling addiction. 

However, dissident voices from GERB-UDF warned about the potential negative impact on municipal sports institutions, noting that such measures would only scratch the surface of addiction’s underlying roots. 

The Proposal Also Included a Fine for Media Outlets

Earlier this week, some of Bulgaria’s best brains joined in the endless debates about gambling in Sofia’s Parliamentary House. The controversy began at the end of last year when Kostadin Kostadinov and his nationalist party, Revival (Bulgarian: ‘Vazrazhdane’), drafted a proposal to change specific provisions of the country’s current Gambling Law.  

Kostadinov’s goal was to develop a more consistent regulatory structure. One noteworthy point of interest was the near-complete revision of advertising restrictions at best online casinos.  

The reforms were sought because the political party Vazrazhdane feels that they are required to combat the onslaught of ads for gambling that dominate TV, radio, and other electronic media, reaching children and vulnerable people – a clear violation of present legislation. 

Four months after Vazrazhdane stated the draft, Kostadinov spoke from the Parliamentary tribune on March 29th, criticising his colleagues for their lack of interest in the document and the failure of the competent committees to review it.  

According to the Bulgarian News Agency, he said that Vazrazhdane would once again campaign for the amendments’ adoption, bringing the proposed modifications up for consideration during the first plenary session in April.  

Will Banning Advertising On Gambling Solve Any Problems

Lyuben Dilov, a member of the GERB-UDF party, expressed concerns about the proposed Gambling Act changes. According to Gambling News, Dilov went on to say that if the proposed modifications, which include a blanket ban on gambling advertising, are passed, these institutions will lose a significant source of revenue. 

He was especially concerned about these reforms’ potentially harmful impact on municipal sporting institutions, which frequently rely on sponsorships and relationships with gambling enterprises for money and sponsorship.  

Dilov disagreed with the idea of entirely prohibiting gambling advertisements. He stated that such a policy would simply address the symptoms of gambling addiction rather than the underlying reasons. In his opinion, the core causes of gambling addiction are linked to human nature and personal circumstances, which he feels should stay “untouched and unchanged”.  

This implies that he believes people should be free to make their own decisions, including the decision to gamble at low-deposit casinos. Instead of implementing blanket restrictions, more focus should be placed on providing treatment and support to people suffering from addiction. 

In essence, Dilov’s argument is about striking a balance between the necessity to protect vulnerable people from the evils of gambling and the potential economic consequences of severe laws, as well as addressing the main causes of gambling addiction. 

Implications for the Gambling Industry in Bulgaria

During the parliamentary debate, Clement Shopov, a fellow Revival member, raised the issue of problem gambling, referring to it as ‘the quiet addiction’ due to the stigma associated with it. He listed other European countries, including the Netherlands, Belgium, and Italy, as examples of severe advertising regulations Bulgaria should try to emulate. 

He emphasised that the goal of gambling ads, in his opinion, was not just to attract new customers at casinos with a minimum deposit but also to hold the attention of vulnerable people – who, it was argued, were the most profitable for the gambling industry.  

Regarding the planned withdrawal changes, Shopov stated that consumers should be able to get quick deposits and winning settlements from land-based casinos up to a maximum of $/€5,000. He believes this will discourage clients from returning since banks can sometimes take several days to transfer payments. 

Furthermore, Shopov advocated for eliminating gambling operator licencing fees in favour of a 15% tax levy on all deposits made, as was the case before 2014, when the Bulgarian Socialist Party was in power. He believes this will create a more equal and viable gambling industry in Bulgaria. 

Another proposed change was to compel players to stay on the self-exclusion register for at least two years. This was done to address players’ ability to migrate between online casinos and get past bans. 

The proposed amendments were rejected in a recent plenary session because the political majority abstained despite the support of a populist minority. However, the future of Bulgaria’s gambling business remains undetermined, as early elections will likely occur in June.

• Tax Revisions: Proposed changes would bolster fiscal revenue, particularly through equal taxation of land-based and online wagers on sports, horses, dogs, and random events, as stipulated in the amended Gambling Act. 
• Impact on Sole Traders: Amendments could heighten financial requirements for small entities within the sector and restrict sole traders’ access to casino and gaming hall licenses, potentially impeding their participation in the industry. 
• Self-Exclusion Measures: Improving the efficacy of the national self-exclusion registry could provide better protection for people who want to refrain from gambling activities. This falls in line with responsible gambling measures and could help minimise problem gambling.  
• Increased Payouts: Doubling land-based win payouts from $/€2,500 to $/€5,000 may enhance the appeal of land-based gambling for players, yet could also foster increased gambling activity and, consequently, problem gambling occurrences. 

Following the proposal’s defeat, all stakeholders are now intensely focused on the Bulgarian Parliament, waiting to see whether the proposal will be revised for re-submission or a new proposal will be created and submitted to the parliamentary floor for discussion. New layout requirements for venues have been put in place to make it easier for the staff to monitor the ATMs from the main bar or service area. Additionally, the new layout ensures that the gaming machines are not visible from outside the venue.

Many of the workers in these locales are already dealing with an understaffed workplaces (like most hospitality industries in New Zealand).
