Offshore gambling operators to pay 12% on betting revenue from July

New Zealand Finance Minister Nicola Willis has confirmed that the new coalition government will be addressing the commitments made regarding the taxation of offshore gambling operators later this month, which is expected to bring about a significant legislative change for NZ online casinos.
Earlier electoral promises had included the imposition of a gambling duty on gross betting revenue. Following Willis’s statement, it is expected that this 12% duty will start being imposed starting July 2024.
In a statement to New Zealand media, the minister referred to the current situation as a “long-standing tax anomaly”, while promising that the upcoming May budget would take concrete steps to address the situation via the National Party Tax Plan that is endorsed by the Coalition Agreements.
More about the amended NZ legislation
The new tax will affect all NZ online casinos, however, it requires an amendment to the current legislation to be tabled in parliament. This is expected to happen by the end of March. An Amendment Paper to the Taxation (Annual Rates for 2023–24, Multinational Tax, and Remedial Matters) Bill has already been issued by the Ministry in what is being described as the first step towards full implementation that will see all the New Zealand government’s tax commitments implemented.
The bulk of the amendments are included in Amendment Paper Number 20, which includes all the provisions related to offshore gambling that will be added to the current Gaming Duties Act 1971.
Thanks to this new tax, Willis told the press in New Zealand, the Kiwi government will be able to announce a reduced personal tax rate in the upcoming budget of May 2024, meaning that all New Zealanders will be able to keep a bigger percentage of what they earn.
The proposal had seen the main political parties clash ahead of the 2023 general election, with the Labour Party claiming that tax was already being paid by offshore betting operators as a “point of consumption charge” and denying there was any loophole. However, the matter was resolved as the new amendments specifically excluded amounts from betting on sports and racing due to the existing requirement to pay the point of consumption charges to the Department of Internal Affairs on these amounts.
The current coalition is now in agreement about introducing a 12% tax, which is expected to generate $2.31 billion in NZ over the next four years. However, these predictions have attracted a fresh wave of criticism, with the New Zealand Herald claiming that the figures don’t match Inland Revenue Department estimates, which are expecting only NZ$35 million for the first year, gradually increasing to about NZ$155 million over four years.
Minister Willis acknowledged the discrepancy, but reiterated her confidence in the new tax regime, stating that the gap in estimates would be closed in the upcoming years. The main points governing the new regime will be as follows:
- It applies to GST-registered persons who are located outside New Zealand and who supply remote gambling services to New Zealand residents.
- Tax will be charged at a rate of 12% of the offshore gambling profits.
- Offshore gambling profits are calculated as the amounts received from residents, minus the prizes paid to residents, minus any offshore betting amounts.
- If the offshore operator has a negative amount of offshore gambling profits for a return period (because it has a greater amount of prize money paid or payable to New Zealand residents, than the amount of money it has received from residents) it will carry forward this negative amount to offset future offshore gambling profits in its next return periods.
Are NZ-based gambling operators affected?
Of course, the new tax system is expected to leave a significant dent in the revenue of NZ online casinos, given that before this there were no tax requirements imposed on the gross revenue. Under the current system, in fact, the only tax that applies to offshore online casinos is the GST – or the Goods and Services Tax, which is a kind of value-added tax applied that is charged at each step of the supply chain but is mostly borne by the final consumer, in this case, the New Zealand gambler. The tax is charged at a flat rate of 15% and is applicable both to offshore gambling platforms and physical ones.

Online betting firm 888 Holdings recently reported an 8% decrease in total annual revenue, which they attribute largely to stricter safer gambling regulations enacted in the UK and Ireland. According to the company, moving away from unregulated markets and adhering to the new rules cost them around EUR80 million in lost sales last year. Their UK and Ireland divisions were hit especially hard, with online revenue falling from EUR1.85 billion in 2022 to EUR1.71 billion in 2023.
Last year, the government announced a raft of gambling reforms, including a mandatory levy on sports betting firms and UK online casinos to fund treatment of gambling-related harm, in its bid to protect vulnerable players in the smartphone era.
The news comes after a chaotic 2023 for William Hill owner 888. Last March, compilers at the London Stock Exchange (LSE) removed 888 Holdings from the FTSE 250 index after its shares plunged 72% in 12 months.
That same year, the company lost its CEO Itai Pazner, faced a money laundering probe, and was hit with a record £9.4m fine over a series of social responsibility and money laundering violations.
The company through its spokesperson said it will have to take “the difficult decision” to make redundancies to counter the issues but did not disclose which departments will be affected.
“We are making some changes to our organizational structure that will better position the group to achieve its long-term strategic plans. As part of this, regrettably, some roles will be made redundant across some of our locations. We will be offering our full support to those colleagues who are impacted,” said an 888 spokesperson while speaking with iGB.
The spokesperson also confirmed the company will continue investing in intelligent automation and AI-powered data and insights.
Meanwhile, 888 new CEO Per Widerstrom introduced a £30 million cost-cutting scheme in December. He also announced the firm is taking swift actions to position the group for future growth. This includes freeing up funds to invest in growth and reducing overhead costs.
The firm has already closed one of its 11 global offices in Sofia, Bulgaria’s capital city, and made job cuts in Israel. It has a global employee size of around 11,000.
Speaking to The Sun about the new changes, Per Widerstrom, who took over as CEO in October 2023, said: “We must be more proactive in adapting to changes in regulation and technology.”
He added that the new changes have created a more sustainable business for 888. This includes generating approximately 95% of revenue from regulated and taxed markets.
Widerstrom also noted that 888’s financial performance must improve and pledged to unleash additional plans after the annual results are out in March.
Additionally, the company will shift its focus towards recreational customers and enhanced gambling protection measures.
“In FY23, the group made important strategic and operational progress in the face of some significant regulatory and compliance headwinds. I am pleased to say that the business has enhanced its foundations for sustainable and profitable growth including significantly strengthening compliance, refining its approach to marketing investment and increasing its focus on recreational customers,” Widerström said.

Decoding the Safer Gambling Measures
Last April, the UK’s gambling regulator imposed sweeping new rules meant to increase protection for vulnerable individuals in the digital gambling age. Under these new guidelines, operators face stiffer requirements to put preventative measures in place to identify and protect higher-risk players.
Key among the proposals announced by Lucy Frazer, Secretary of State for Culture, Media and Sport, included new stake limits for online gambling. Under the statute, a maximum stake limit of between £2 and £15 was recommended for online slot games.

The government proposed that vulnerability checks should kick in at £100 of monthly losses. “As the detailed implementation of the review now begins, we will also be reiterating to all operators that the Commission will strongly maintain its focus on consumer protection and compliance.”
